General Terms and Conditions

Basics:

1. all sales are to be viewed using the points below.

All product prices are in Euro, including Austrian VAT (20%) and excluding any shipping costs.

3. you must be at least 18 years old to shop with us.

4. we are a fair trading partner and expect the same from you.

5. misunderstandings, ambiguities and mistakes should not, but can happen - we will ALWAYS try to solve things together with you in the best possible way.

6. consider the legal situation in your country! All products may only be used within the framework of the laws applicable to you. By accepting these terms and conditions, you confirm that you will indemnify and hold us harmless for any violations on your part. We strictly reject any responsibility for misuse of our products!

7. the relevant laws as amended from time to time shall apply.

For legal reasons, vaporizers can only be shipped upon presentation of an ID. Simply send us a picture of your passport or ID card by email or encrypted messenger. The data will be deleted immediately after sending! Please inform yourself about the legal situation of the offered electronic devices or glassware before buying! We assume no liability for misuse!

1 Applicability to entrepreneurs and definitions of terms

(1) The following General Terms and Conditions of Business apply to all deliveries between us and a consumer
in the version valid at the time of the order.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither
attributable to their commercial nor their independent professional activity (§ 13 BGB).

2 Conclusion of a contract, storage of the contract text

(1) The following regulations on the conclusion of the contract apply to orders placed via our internet shop https://www.donaulife.com .

(2) In the event of conclusion of the contract, the contract shall come into force with

(3) The presentation of the goods in our Internet shop does not constitute a legally binding offer of contract on our part,
but is only a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer makes a binding offer to conclude a purchase contract.
(4) Upon receipt of an order in our Internet shop, the following regulations shall apply:
The consumer makes a binding offer of contract by successfully completing the order procedure provided in our Internet shop.

The order is placed in the following steps:

1) Selection of the desired goods

2) Confirm by clicking on the "Order" buttons.

3) Checking the information in the shopping cart

4) Pressing the "checkout" button

5) Login to the Internet shop after registering and entering the login details (e-mail address and password).

6) Re-check or correct the respective data entered.

7) Binding submission of the order by clicking the button "order with costs" or "buy".

Before the binding submission of the order, the consumer can return to the Internet page on which the customer's details are recorded and correct input errors or cancel the order process by closing the
Internet browser by pressing the "Back" button contained in the Internet browser used by him after
checking his details.
We confirm receipt of the order immediately by means of an automatically generated e-mail ("order confirmation"). With this we accept your offer.

(5) Storage of the contract text for orders via our internet shop : We store the contract text and send you the order data and our GTC by
e-mail. You can also view the GTC at any time at https://www.donaulife.com/agb/.

You can view your past orders in our customer area under My Account --> My Orders.

3 Prices, shipping costs, payment, due date

(1) The prices stated include the statutory value added tax and other price components. Shipping costs, if any, shall be added.

(2) The consumer has the option of paying by bank transfer, Sofortüberweisung, Bitcoin, Potcoin or credit card (Visa, Mastercard, American Express).

4 Delivery

(1) Unless we have clearly stated otherwise in the product description, all items offered by us are ready for immediate dispatch.
Delivery here takes place within 5 working days at the latest.
In the case of payment in advance, the delivery period begins on the day after
sends the payment order to the bank commissioned with the transfer and, for all other payment methods, on the day after conclusion of the contract.
If the deadline falls on a Saturday, Sunday or public holiday at the place of delivery, the deadline ends on the next working day.

(2) The risk of accidental loss and accidental deterioration of the item sold
shall not pass to the purchaser until the item is handed over to the purchaser, even in the case of sale by delivery to a place other than the place of performance.

5 Retention of title

(1) Unless otherwise agreed, the goods shall be delivered from our
warehouse to the address specified by you.

(2) The goods shall remain our property
until the purchase price has been paid in full.

(3) We are exceptionally not obliged to deliver the ordered goods,
if we have duly ordered the goods on our part but have not been supplied
correctly or on time (congruent covering transaction).

The prerequisite is that we are not responsible for the lack of availability of the goods and that we have informed you of this circumstance without delay.
In addition, we must not have assumed the risk of procuring the ordered goods
. In the event of corresponding unavailability of the goods,
we will immediately refund to you any payments already made. We
do not assume the risk of having to procure goods ordered
(procurement risk). This also applies to orders for goods that are only described in terms of their type and
characteristics (generic goods). We are only obliged to deliver
from our stock of goods and the
goods ordered by us from our suppliers.

8 Warranty

(1) Unless expressly agreed otherwise, your
warranty claims shall be governed by the statutory provisions of the
law on sales (§§ 433 ff. BGB).

(2) If you are a consumer within the meaning of § 13 BGB (German Civil Code), the
limitation period for warranty claims for used goods -
deviating from the statutory provisions - is one year. This
limitation does not apply to claims based on damages arising from
injury to life, limb or health or from the
breach of a material contractual obligation, the fulfilment of which is a prerequisite for the
proper performance of the contract and
compliance with which the contractual partner may regularly rely on
(cardinal obligation) as well as to claims based on other damages which
are based on an intentional or grossly negligent breach of duty by the
user or its vicarious agents.

(3) In all other respects, the statutory provisions shall apply to the warranty.

(4) If you are an entrepreneur within the meaning of § 14 BGB (German Civil Code), the statutory
provisions shall apply with the following modifications:

- Only our own specifications and the manufacturer's
product description are binding for the quality of the goods, but not public
promotions and statements and other advertising by the manufacturer.

- You are obliged to examine the goods immediately and with due
care for deviations in quality and quantity and to notify us
of obvious defects within 7 days of receipt of the goods.
Timely dispatch is sufficient to meet the deadline. This also applies to
hidden defects discovered later from the time of discovery. In the event of a breach of the
duty to inspect and give notice of defects, the assertion of warranty claims
is excluded.

- In the event of defects, we shall provide warranty at our discretion by rectification
or replacement delivery (subsequent performance). In the event of subsequent improvement,
we shall not have to bear the increased costs incurred by transporting the goods
to a place other than the place of performance, provided that the
transport does not correspond with the intended use of the goods
.

- If the supplementary performance fails twice, you can demand a reduction or withdraw from the contract at your discretion
.

- The warranty period is one year from delivery of the goods.

11 Cancellation policy

RIGHT OF REVOCATION
You have the right to revoke this contract within fourteen days without giving any reason. This period is extended to 30 days by us as a gesture of goodwill.

The withdrawal period is fourteen days from the day on which you or a third party commissioned by you, who is not the carrier, has taken possession of the (last) item(s).

In order to comply with the withdrawal period, it is sufficient if you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

CONSEQUENCESOF CANCELLATION
If you cancel this contract, we must refund to you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us). For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. You must return or hand over the goods to

without undue delay and in any case no later than 30 days from the day on which you notify us of the revocation of this contract. The deadline is met if you send the goods before the expiry of the period of 30 days. You shall bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the condition, properties and functioning of the goods.

END OF THE CANCELLATION POLICY

EXCEPTION TO THE RIGHTOF WITHDRAWAL
The right of withdrawal does not apply to distance contracts for the delivery of goods that are made to customer specifications or clearly tailored to personal needs, sound and video recordings or computer software that are delivered in a sealed package, provided that the seal has been removed after delivery, or to sealed goods that are not suitable for return for reasons of health protection or hygiene and the seal has been removed after delivery.
